- Acceptance of Terms and Conditions –
By using or accessing the Service, you agree to be bound by these terms and conditions of use and Privacy Policy. Please read the following Terms Carefully. If you do not agree with the terms, do not use the Service. If you do not agree to all of these Terms then you may not access or use the Service. If you breach any of the Terms or Official Rules of the Service you authorization of use the Service automatically terminates.
- Changes to the Terms and Conditions-
Provider has the right to revise and amend these Terms and Conditions of Use from time to time in its absolute discretion but for reasons, including, but not limited to changes in market conditions affecting Providers business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirement and changes in Provider’s system capabilities. In the event we do so we will post the changes on this page and the date of the changes at the top of this page. You are responsible for regularly reviewing the Terms and Conditions of Use. If we make what we consider to be material changes to the Terms and Conditions of Use, we will send a notice to the e-mail address on file for you and you will be required to affirmatively assent the changes prior to again using the Service. If you do not agree to the Terms and Conditions of Use or any changes or updates, your sole remedy is to cease using the Service. If you breach any of the Terms and Conditions of Use, your authorization 10 use the Service automatically terminates.
- Third Party Payment Processors-
Provider uses third-party electronic payment processors and financial institutions (Payment Processors) to process payments for services made through the Service., The information that we provide to and receive from these payment Processors and the manner in which such information is used and disclosed is described in further detail in the Privacy Policy. You irrevocably authorize us, as necessary, to instruct such Payment Processors to handle payments and you irrevocably agree that Provider may give such instructions on your behalf in accordance with your requests as submitted through the Service. You agree to be bound by the terms and conditions of each applicable Payment Processor, and in the event of conflict between these Terms and Conditions of Use and the Payment Processors terms and conditions then these Terms and Conditions of Use shall prevail. You agree that Provider is not liable for any loss caused by any unauthorized uses of your credit card or other method of payment by a third party in connection with your use of the Service, except as a result of the gross negligence of the Provider or its employees.
- Conduct Restrictions-
You agree to use the service only for lawful purposes Unacceptable uses of the service include without limitation: (i) engaging in any illegal activity or the planning of any illegal activity; (ii) disseminating or transmitting statements or material that, to a reasonable person, may be abusive, obscene, pornographic, defamatory, hassling, grossly offensive, vulgar, threatening or malicious; (iii) creating, disseminating or transmitting files, graphic, software or other material that actually or potentially infringes the copyright, trademark, patent, trade secret, publicity or other intellectual property rights of any person. If you wish to report any abuses, inappropriate online conduct or a violation of Provider’s Terms and conditions of use, please forward all evidence of the same to dedicatedtimeshare@outlook.com.
- Privacy Policy-
Your use of the Web site is subject to our Privacy Policy. That policy explains how DTS treats your personal information and protects your privacy when you use the service. Your acceptance of the Terms and Conditions is also your consent to the information practices in our Privacy Policy.
- Our services to those selling or buying timeshares
Because transactions in Timeshares and other real estate interests often involve several parties, each with different roles, we want to be clear about the services DTS provides. DTS is a company focused on assisting the buyer, seller and broker in transferring a week. Other services include owner to owner transfers, adding or removing parties due to a divorce, death or placing in a trust.
- Our services to those selling or buying timeshare: Cancellation Rights and Refund Policy
In the event of cancellation as a result of Buyer actions, Buyer understands all monies paid are subject to any and all charges and/or costs incurred by Dedicated Timeshare Services LLC. The balance of said monies will be forfeited to Seller within 20 business days by credit card or check, (which ever was deposited). If the Seller cancels the purchase or if the Seller incorrectly advertised or communicated the description of their timeshare causing the Buyer to cancel the transaction, then Seller agrees to reimburse Dedicated Timeshare Services LLC for any and all fees and/or costs incurred on their behalf. All funds charged to the buyer’s credit card will be refunded to the credit card on file within 72 hours of the cancellation. If the resort exercises its right of first refusal, the Seller agrees to pay $75.00 for work performed by Dedicated Timeshare Services LLC.
- Limitations
Unless otherwise provided within the Terms of Use, you may not:
- Place false or misleading information on the Website.
- Use the Website to make any false, fraudulent or speculative claims or reservations
- Imply in any way that DTS is endorsing your property, products or services.
- Post or transmit any unlawful, threating, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence give rise to civil liability or otherwise violate any law, or fix any other purpose that is unlawful or prohibited by the terms and conditions.
